In Australia, can I fly a Drone over a Property?

NOT AT ALL. Home and private property are not permitted to be overflown, which includes backyards and swimming pools.

What are my options for flying drones at the beach or in a park?

Only if no one is around. It is not allowed to fly close to people, so only abandoned beaches and parks will do.  In the case of encountering a person while using a drone, such as when hiking through a national park or in the park  using a drone, you should lower the drone immediately.

What are the RULES for flying my drone in Australia?

Anywhere in Australia where you are flying a drone, you must abide by certain rules in order to ensure your safety as well as the safety of the public and the drone.

  • Limit your flight height to 120 meters.
  • Do not fly within 30 meters of populated areas.
  • Do not fly multiple drones at once.
  • Maintain a clear line of sight.
  • Overflying other people is not allowed.
  • Fly at least 5.5 km away from controlled airspace.
  • Your Drone should always be visible to you, without the use of binoculars or a video screen. As a result, you can’t fly in the dark, in fog or clouds, and you can’t fly behind buildings or trees, etc.
  • If your drone presents threats to property, someone, or another aircraft, you cannot fly it.
  • You are not allowed to fly your drone near or over areas where emergency operations are going on without prior approval, or in an area that affects public safety. Firefighting efforts, rescues, crashes, searches and police operations are all included here.
  • It is prohibited to fly your drone in restricted or prohibited areas.


Is it okay to take photos and videos without an authorization?

You may take photos or videos with your drone without law or regulation, but if you take unauthorized photos or videos of anyone, the office of the Australian information commissioner may be contacted for a privacy complaint.


When flying my drone, can I fly near pets or animals?

Pets and animals may not have a problem with drones flying near them, but other people’s animals or pets might find the drone noisy. Not only do you scare the animals, but the animals are also more likely to damage the drone if they drag it out of the air.


What do you consider a commercial drone activity?

CASA has outlined a few examples of activities that could be considered commercial or business-related, including:

  • Content creation for sales, such as photos and videos.
  • Visiting commercial sites, equipment, or infrastructure to inspect them.
  • Content monitoring for sites with advertisements that generate income

Do I need a Drone License in Australia?

The person who flies a drone or supervises its operations, or those who fly drones commercially, will need either a Civil Aviation Safety Authority (CASA) license (remote pilot license) or operator accreditation certificate. 


Age limit for a drone license in Australia

Drones can only be registered by individuals 16 years or older. A responsible adult (18+) must supervise anyone under the age of 16.
